Appeals uphold denial of new trial for Covender
The 9th District Court of Appeals rejected Joel Covender's bid for a new trial, agreeing Lorain County Judge James Miraldi correctly found insufficient new evidence. The panel said testimony from Covender's former stepdaughter, who says she has no recollection of molestation, could not justify retrying the case. Prosecutors noted only a written statement by the stepdaughter's biological father indicated coercion, not enough for a new trial.
