Ohio Supreme Court declines appeal in railroad damages case
The Ohio Supreme Court refused to review an appeal from Athens County decisions favoring the Baltimore and Ohio Railroad. A lower court awarded $23,064 for damage to a diesel locomotive after a truck struck the train near a Canaanville crossing in 1960. Testimony showed the track drifted onto the rails, and a 1964 Common Pleas jury ruled Merchants Delivery, Inc liable for the railroad damages.
