Six Year Residency Required for Homestead Exemption
A district court ruling affirms that a homestead exemption requires a resident family and a family residence within the state. The court holds the mortgage valid and upholds the denial of exemption where the family’s future relocation to the state is uncertain and six years pass without their arrival from a foreign country. The decision emphasizes that mere intent to move, without actual removal in a reasonable time, does not meet the statute’s requirements. Bowen & Adams and Beaton represent the parties.
