Fight Over Water Special Assessments In Avon Lake

A suit to enjoin county taxing officials from collecting water works special assessments against Avon Lake farmers was heard by Common Pleas Judge D A Cook. Plaintiffs Albert Klingshirn and Clarence Smith claim many parcels near the water line receive no benefit, yet face $17,000 in assessments based on $19 per acre. County records show $406,000 in bonds and interest remain, with delinquent taxes prompting levies against all county property. Prosecutor Butler argued the measure reflects value at the time of improvement in 1925 1926, not current worth, while Treasurer Wright itemized remaining bonds and interest due through 1949.
