The case tests a 1977 Public Works Employment Act provision reserving 10 percent of funds for firms at least 50 percent minority owned. Plaintiffs claim it creates race-based classification and violates equal protection and Title VI. Courts largely upheld the law. the justices will consider Congress findings and remedial power.
