Defense: Rodrigues intended robbery not murder at Lorain store
Defense attorney James Kersey argued that Decio Rodrigues entered Gonzalez Grocery on January 25 2008 to rob the neighborhood store not to kill owner Jose Gonzalez. He said Rodrigues carried a car jack handle and a struggle over a gun caused it to discharge. Assistant prosecutor Laura Dezort described the case as capital murder.
