Court Rules Against Federal Immunity
Idaho Supreme Court rules there is a limit on federal immunity for agencies acting beyond rules. Justice Charles Donaldson writes the agency may bind the United States to agreements within its empowered scope, reversing a lower court and remanding for a new trial. The 1968 case involved Lyle Pitner who claimed FCIC misled him about insurability of wheat after barley acreages were damaged.

Judge rules tribal ban on lawyers violates law
Federal Judge Fred M. Taylor ruled the Shoshone Bannock Tribal Court ban on professional attorneys is contrary to the U.S. Constitution. The decision stems from a civil suit by Fort Hall residents Leroy and Zelphia Towersap against the tribal council and court after their Cat fish Pass attorney was ordered from a criminal case courtroom. The ruling affirms defendants’ right to legal counsel of their choice at tribal court proceedings, while allowing non professional advisers in certain criminal contexts.
