Jury takes case in Enos Rontzahn vs Washington Biser
The Washington state damages action in Hagerstown was withdrawn from the jury. Rentzahn of Frederick county claimed an oral one year farm lease on Biser’s Boonsboro Keedynville property with April 1 1904 possession and shared stock and crops, while Biser contested fraud and possession requirements. The court ruled parole evidence cannot prove a lease under the statute unless possession occurred, and then the jury was excused.
