Judge overrules zoning board in Esco case
Butler County Common Pleas Judge Robert L. Marrs finds the Middletown Board of Zoning Appeals acted arbitrarily in denying a variance for Esco Distributing Co and Jo Ann Fabric Shop. Although the board refused, city commissioners later approved a zone change allowing the stores to remain. Referendum petitions to overturn the commission decision were ruled improperly filed.
