Ohio marijuana sentences deemed cruel and unusual by court
The 6th U.S. Circuit Court of Appeals ruled that Ohio prison terms for marijuana offenses may be cruel and unusual. Downey, a Cleveland resident, faced 10 to 20 years for possession for sale and 20 to 40 for sale, challenging Ohio’s 20 year minimum. The opinion questions proportionality and urges alignment with contemporary standards. The piece also notes the Granite Railroad in 1826.
