Provisions Of New Tax Rules For Home Sales
Harry A. Willson of the New Jersey Association of Real Estate Boards explains Section 141 of the Internal Revenue Code. Under rules, persons aged 65 or older who sell their primary residence and meet the use test may exclude gains up to the adjusted sale price if within limits. If the sale exceeds $20,000, only part of the gain is exempt, with specifics shown by example. The exemption applies once in a taxpayer’s life, and the five-of-eight-year use must be met, with survivor rules for widows or widowers aged 65 or over.
