Springfield reports the Bauer embezzlement case jury was excused after failing to agree. Eleven favor acquittal and one for conviction. The panel began voting at 5:45 p.m. after a long session, marking the second mistrial in the two months since the first trial.
It is reported that the Cox heirs and Samuel Jett settled civil suits against Judge Hargis and others for 8 000, with the Cox heirs receiving 6 500 and Jett 1 500. The agreement closes civil and criminal actions linked to the Breathitt county feud, leaving only John Abner’s possible Cox murder case to be tried.
In Brooklyn last night Elsie Kerlin 22 a telegraph operator and Bernard E Wallace of Commercial Cable were shot in a taxi. Wallace 18 killed Kerlin then shot himself dying instantly. Police suspect a love affair motive.
In Lebanon Delaware, William H. Miller stands trial for the murder of Joe Litteler, described as the man who allegedly despoiled his home. The jury began deliberations around noon after prosecutor Young's closing argument, as Miller showed restlessness in court and his wife, linked to Litteler by elopement rumors, did not attend.
Governor Harris will review testimony before granting respite for Frank Earl the Sidney murderer electrocuted next Friday. Attorney W C Koons Mt Vernon represents Earl and seeks a United States Supreme Court appeal with funding from Cincinnati parties.

Charles Berger, patient at St. Margaret's hospital in Hammond Indiana, escaped barefoot in only trousers and walked four miles through the snow to his Hegewisch home. The trek aided his recovery and he is expected to recover fully.

M. L. Dillon, a traveling salesman, shot and fatally wounded Mrs. N. G. Cochran as she slept then killed himself. Dillon had deserted his wife and urged a separation from Mrs. Cochran after she rejected his attentions, leading to the tragedy.
Justice Gould granted a temporary injunction in Washington DC preventing the American Federation of Labor from continuing its boycott of Buck Stove and Range company of St. Louis. The injunction, sought by President Van Cleave, halts action pending final settlement of the dispute over boycott rights.
Mrs. John Ferguson reported to Marshal Bracker that a man tore the rear curtain from her covered farm wagon in New Burlington and stole her pocketbook containing about five dollars and spectacles. In Wyoming, John Mueller's coal office on the C H D tracks was burgled with eight dollars in stamps taken. a safe was unsuccessfully forced and drilled near the hinges.
In Common Pleas Court on Tuesday Judge Gard and a jury heard the Hamilton Artificial Stone Co against Clara Schramm suit over an $800 lease claim while Schramm sought $2500 for alleged construction defects. The Sherrod case with Cincinnati Northern Traction was settled and dismissed.
The death of Rev. John S Cantwell of Chicago was reported as a significant loss to the Universalist denomination. A funeral was set for 2 o clock tomorrow at the First Universalist Church on Walnut Hills in Cincinnati, reflecting Cantwell's standing among Hamilton and area congregations.

The message arrived as Bern is dead, shocking him into unconsciousness. He paid travel for relatives to Terre Haute for the funeral before learning of the error.
County commissioners surveyor and prosecuting attorney inspected the proposed levee project in Fairfield township. Pauline Benninghofen and other residents petitioned for the improvement.

Mr Brown the Indiana checker champion played four of Hamilton's best at the Y M C A last night. Cory Sutter Penrod and Wood faced him simultaneously and were defeated several times. Sutter won one game, Cory two. Brown, age 19, has defeated champions of Ohio and Illinois. Dr Logan rates him among the nation’s best and believes the experts can be defeated by Brown.

Lincoln Dec 17 W J Bryan urged the state railway commission to build a subway linking the Burlington and Union depots in Omaha to ease passenger transfers between the two stations. He noted the depots lie about 300 feet apart but access is inconvenient due to existing facilities.
