The case, brought by Gallatin valley farmers against Montana Power Co, argued waters of the Madison River were unreasonably impounded and that prior rights existed. Judge Horsky’s writ preventing board jurisdiction was upheld, the court stating the issue was purely judicial and that the legislature gave the railroad commission no such powers.
