Lawyers for condemned prisoners Billy Joe Battie and Kenneth Granviel urged the Texas Court of Criminal Appeals to strike down the new death by injection statute as unconstitutional arguing it is loosely drawn and could allow use of painful substances such as antifreeze. They asserted the legislature failed to specify which drugs may be used.
