Supreme Court rules 1987 chain store tax unconstitutional
In a 3 to 2 decision the state supreme court voids the 1987 chain store tax due to a faulty enacting clause. The ruling refunds eight tax payments totaling 41 000 made under protest from the Vaughan Ragsdale case in Billings. The enacting clause read Be it enacted by the people of the state of Montana instead of Be it enacted by the legislative assembly. Justice Morris writes the majority. Justices Angstman and Erickson dissent.
