New Plea Filed In Slayer Of Cop Donahue Case

A motion for permission to reargue the State Supreme Court appeal of John B. Donahue of Arlington Massachusetts seeks to overturn his death sentence for the first degree murder of State Policeman Ernest J. Morse in Trumbull on February 13 1953. Donahue who stole a Brookline Massachusetts car earlier that day was trying to flee toward New York City when Morse stopped him for speeding. The defense argues improper jury guidance on insanity and questions over Connecticut mercy statute allowing life first degree verdicts instead of death.
