In the U S Circuit Court on January 22 before Judges Webb and Colt the Celluloid Manufacturing Company versus A D Chandler and Edw Spaeth versus Evereth Barney were heard in equity. The demurrer to the reissue bill argued lack of certainty about surrender ground and lack of jurisdictional facts. The court overruled the demurrer holding surrender of the original patent need not be averred in detail and the commissioner's authority is presumed valid unless the patent shows excess. Judge Devens presides in the case Carlo Mauran versus Charles F. Pidgin et al.
