Homestead Exemption Confusion for Married Women
A California real estate attorney concludes that a married woman living with her husband may declare a homestead with the same exemption as the head of the family. The opinion explains that despite Civil Code sections implying the husband as head, Sections 1662 and 1263 let the wife select the homestead and determine the exemption. The analysis says both spouses can sign the declaration if the wife selects the property, tying exemption to the declarant wife rather than strictly the husband head of family.
