Muscotah trio bound over to district court
Harold McCubbin Frank Speer and Ivan Berry appeared in city court and were bound over to the district court for trial in the January term on manslaughter charges in the Muscotah accident that killed Ed Brouse near Muscotah Kansas. The boys will be bound over Friday morning when bondsmen are expected in court for 3000 bonds each while they remain on 2500 appearance bonds. Witness William Johnson testified that McCubbin admitted killing a man on the road east of town. About 30 witnesses testified as both sides pieced together events surrounding the November 11 death and two cars seen around Muscotah without lights. Speer Berry and McCubbin face manslaughter and felony counts for operating a motor vehicle while intoxicated. The defense contended the passengers could not be held for manslaughter. The largest crowd in city court history attended the preliminary hearing.
