Defendants including numerous heirs and trustees are named with residence unknown. The case cites December 1940 ejectment and seeks restitution damages costs and further relief. The petition names R J Bishop Trustee Robert Cramer Trustee John F Eubank Trustee J M Lanham Trustee Michael J O Connell Trustee G B Smith Trustee William Sanford Trustee Southwest Land and Lumber Company and others as defendants. The court is asked to set the matter for the next regular term in Alpine Texas and to determine the legitimacy of the ownership under a chain of title from the sovereignty of the soil. Funeral services were held at 1:30 PM Thursday for George B. Miller known as Shory Miller born September 14 1892 in Throckmorton Texas who died Monday December 29 1940 in Corona New Mexico from a heart attack. He is survived by his mother Mrs Mary P Miller sister Mrs L K Dozier brother Jesse J Miller and several nieces and nephews. Interment was at Marathon Cemetery.
