Appeals court upholds verdict in nurse's husband's death suit
The South Carolina Court of Appeals refused to overturn a jury ruling awarding Kimberly Johnson Welch 7 million dollars after her husband Marshall Welch died following back surgery at Aiken Regional Medical Centers. Dr Franklin Epstein was ordered to pay 3.1 million in actual and 3.9 million in punitive damages for alleged inadequate care and use of a powerful narcotic. Epstein’s counsel argued death stemmed from an unexpected pulmonary embolism unrelated to care. An out of court settlement had been reached with Aiken Regional before trial. Dr Martin Greenberg was found blameless.
