Milk Commission Loses Round In Federal Court
In Alexandria Virginia the Commonwealth of Virginia failed to gain federal court action to bar High's Dairy Products Co from selling milk at 74 cents a gallon in Northern Virginia. Judge Albert V Bryan ruled the court lacked jurisdiction and dismissed without prejudice to sue in Richmond Circuit Court or other state court. The case argued the state, not a citizen, could not invoke diversity jurisdiction and that no federal question existed. High's argued a Virginia Supreme Court decision invalidated the minimum price by the Milk Commission, noting a required maximum price implies a minimum.
