Supreme Court voids 1898 labor discrimination ban
The U S Supreme Court, in William Adair v United States, held that the 1898 act prohibiting railway employers in interstate commerce from discriminating against union members is unconstitutional. Justice Harlan wrote the majority opinion concluding the law violates contracts and cannot be justified by interstate commerce powers. Justice McKenna dissented, arguing the ruling narrows the law. The case arose from a writ of error to the Eastern District of Kentucky.
