Double Tax Is Basis Of Plea

Grand Forks December 18. Railroads plan to seek a rehearing in a supreme court suit over taxation of industrial sites on railroad right of way. They claim the court’s ruling on taxability for elevator and fuel and lumber sites amounts to double taxation, since the land was taxed each year by the state board of equalization and by the occupants. The case involves Northern Pacific Railway company vs Morton county and affects about 2500 elevator sites and 260 oil tank stations. The railroad says local assessors lack authority to tax the right of way. the state board’s assessments and paid taxes show no omission or escape from taxation, and the challenge rests on constitutional grounds.
