Lawsuit claims photo in divorce case fraudulent
Mason City March 8 a petition filed in district court seeks to annul and set aside a prior divorce decree on grounds that the photograph offered as evidence was altered and not taken with the wife’s knowledge. Albert H Brett contends a new image shows five people including the before unseen background figures and asserts no corroborating evidence supported the original adultery and cruelty charges. Lawyers await filing briefs in the Iowa Supreme Court as they challenge the October decree with Brett’s estimated $248,000 wealth and $100,000 alimony at stake.
