Individual Bets Are Legal Noting Them No Violation
Three days before Christmas a raid on the downtown district for handbookmakers resulted in seventeen captured in Dan Costigan's net. In Tombs Court Magistrate Deuel discharged them for lack of proof of lawbreaking after ruling that a private wager between individuals is not a crime. Lynch, charged with accepting bets on horses, was discharged as the complaint failed to prove professional gambling or public betting. Attorneys cited a Shane decision upholding noncrime of private horse bets under certain circumstances. The court ordered discharge for Lynch and the remaining defendants.
