Supreme Court splits over constitutionality of compelled testimony
The Supreme Court upheld a Feldman fraud conviction while a sharp dissent by Justice Black argues the ruling undermines the Fourth and Fifth Amendments. The decision hinges on whether immunity provisions prevent use of testimony in federal prosecutions and highlights state federal conflict in criminal law. Justices Frankfurter and the majority affirm the immunity rationale. Black, Douglas, and Rutledge dissent. The court planned to adjourn for summer.
