Appeals court upholds conviction for attempted rape in Albany
The Appellate Division unanimously sustains Raymond H. Alexander's 1975 Albany County Court verdict for attempted rape and first degree sexual abuse after finding trial judge erred in instructions but the guilt was overwhelming. The decision notes Alexander is serving a prison term amid disputed length. Another ruling upholds James W. Sim Jr.’s 1975 burglary conviction for stealing items from an Albany home, with a dissent questioning sufficiency of the burglary evidence. Sim serves an eight year maximum sentence.
