Supreme Court decisions reshape Cherokee tax exemptions
Oklahoma City reports that the state supreme court reversed its previous stance in the Whitmire case, ruling Cherokee allottees retain exemption from state taxation while lands remain in allottee hands. Justice Kane authored the opinion, noting vested exemption rights under the Cherokee agreement and U S Constitution amendments. Other rulings affirmed, remanded, or dismissed involve Canadian Trading, various county cases, and the Bartlesville gas franchise, with the court limiting city wire and telephone rate control. Chief Justice Turner delivered the Bartlesville decision.
