The Supreme Court, in a divided decision, sustains the income tax law but invalidates taxes on rent income from real estate and on municipal bonds. It holds direct taxes require apportionment among states, while duties and excises apply uniformly nationwide. The ruling notes constitutional history and the 1894 act’s limits.
The Supreme Court splits evenly on the income tax issue. Decrees are reversed and remanded for tax only on rents real estate income and on income from municipal bonds. Justices Field White and Harlan dissent in differing tones, with no full majority opinion.

Madagascar April 10 The state department is puzzled by the delay in a report on ex United States Consul Waller languishing in a French jail in Madagascar. Nine days after cabling Port Louis Mauritius for a report officials suspect French officials hinder information due to prior exequatur disputes.
The Wisconsin Fire Relief Commission, created by Governor Upham, opened headquarters in Marshfield to distribute seed grain and provisions from a $10 000 appropriation. Captain H A Chase C K Erwin and Joseph Warringer lead efforts after visits to Price Taylor Ogema and Phillips where 107 were reported destitute. About 50 are true fire sufferers. Ogema raised 110 for relief as work begins to reach burned districts.
In Cleveland the Amalgamated Association of Iron and Steel Workers says a wage scale increase will be sought at the upcoming convention. An officer cites improved iron industry and the Finishers' union settlement as support. About 250 delegates are expected.
John D. Rockefeller, fearing arrest on warrants across states, remains in New York. Interrogatories have been submitted by both sides to be answered before the federal district court clerk. His attorney's direct interrogatories total 117 while cross-interrogatories reach 42.
The Krag-Jorgensen army rifle was publicly tested a second time at Fort Leavenworth. Distances ranged from 1,000 to 5,000 yards. At 1,000 yards a bullet passed through 36 inches of oak without deformation. At 2,000 yards an inch steel plate was penetrated. At 1,500 yards a missile traversed a human cadaver and 24 inches of oak.
Con cord Hancock county faces closure as its post office ends, leaving the county seat without mail service. Rumors suggest moving the seat to Britt or Garner, a change that could erase Concord from Iowa’s map.
In Washington on April 10 the extension bid for the Mankato federal building was checked and found within the appropriation limits. The proposal awaits official action, but authorization to begin work is expected soon.

The Minnesota oratorical contest at the House of Hope church drew a large audience in St. Paul. E. M. Phillips of Hamline won first prize, A. L. Helliwell of the state university second, and F. H. Forrssell of Carleton third.
W W Erwin submits a fourteen point brief challenging trial rulings in the appeal for a new trial. The points accuse errors on admissibility of testimonies from Blixt Hayward Vallely Mrs Blixt Emma Goodale Hazleton Norred Myers Hance Goodsell Odell Adry and Jenks plus rulings on insanity evidence and rebuttal testimony. The brief will be presented to Judge Smith next Saturday.
General Secretary Kelliher of the A R U told Lodge 479 in Minneapolis that the union is strong and will spark a broad upheaval. He predicts a move toward cooperative industries and the sweeping away of current social laws and institutions. He criticized the Chicago trial for relying on aged English law as precedent.
Washington April 10. The Northern Pacific Railroad company plans to withdraw all lands along its line from sale until they are classified and patented under recent congressional acts. The measure halts settlement of railroad lands in several Western states for the present.
Dollburn April 10. The tug Record broke through the ice blocking Duluth harbor after a lengthy effort and then aided the fishing tug Eviston which followed southward. The through passage allows any vessel to enter Duluth harbor now.
The April 10 session explored signatures on bank bonds at Redfield. Attorney General Crawford says he has no knowledge of Taylor being in Chili or elsewhere and dismisses the Vintan story as an officers distraction.
Madison Wisconsin April 10 Sheriff Holmberg of Minneapolis arrested George Johnson and Hans Onsland who are wanted in Minneapolis on grand larceny charges. Both men served as collectors for Knud Asieson a wholesale grocer there.

Governor Upham signs a measure creating a state home for the feeble-minded with an annual 50 000 dollar appropriation for this year and 50 000 dollars for the next year.
In Menominee Michigan on April 10 the wind backed from northeast to north reducing risk of further damage from heavy shore ice. Ice remains piled in some areas from 380 to 35 feet high as conditions change.

The ice is going out of the harbor at Bayfield Wisconsin and navigation has begun. This marks the earliest opening since 1890, with ice leaving the bay only three times in the past 45 years.
Mrs. Joan G. Foster of Canandaigua New York reports long battle with eczema and skin eruptions ended after using ten bottles of the product called the Discovery. She says years of doctors failed to help but the remedy cured her entirely.
