Sale Of Property Set Aside In Common Pleas Court
Judge D A Cook set aside a sheriff sale of Mrs Mary Morris property after purchaser J L Edwards filed a motion arguing he bought the property under the understanding taxes were settled. The case tests a new tax statute for sheriff sales after October 1 claiming all taxes are paid. Pepples Banking Company, foreclosure plaintiff, contends the property was sold subject to 1935 taxes totaling about 90 dollars. Deputy Claude Adams reported the estimated tax amount. 1935 taxes are not due until January, suggesting withholding taxes if the sale proceeds.
