Supreme Court Backdrop to Ohio Discovery Rules
The 1963 ruling requires prosecutors to share exculpatory material, but Ohio enforces a narrow 34 year old rule that limits disclosures to listed items and allows prosecutors to decide what is exculpatory while defense access remains restricted. Other states cited provide full and free discovery including police reports and witness statements.
