Medina paper not required to bargain with union ruling

The 6th U.S. Circuit Court of Appeals ruled Medina County Publications need not bargain with Cleveland Typographical Union No 53 because sports editor Steve Dungren was improperly included in the bargaining unit. The panel said Dungren’s disciplinary actions showed independent supervisory authority, defining him as a supervisor and not a bargaining unit employee. The NLRB had sought enforcement of a bargaining order after an election that certified the union, but the court voided the order on legal grounds.
