Georgia Supreme Court Returns Child Custody Over Race

The Georgia Supreme Court ruled 5-2 that Katherine Blackburn may keep custody of her 3 year old son Nicholas, overturning a lower court decision. The case arose after Blackburn, who had an illegitimate daughter with a black man, faced accusations of unfitness tied to race and infidelity. The court found no present unfitness and noted Blackburn shows mature judgment and resourcefulness. The dispute drew in Millen and the Ku Klux Klan, with a prior judge awarding custody to Nicholas' grandmother.
