Pete Franklin, host of a Cleveland WWWE show, saw a $15 million defamation lawsuit by former Cavaliers owner Ted Stepien dismissed by a Cuyahoga County judge. Franklin said the case never should have gone to court and that nothing said was outside the money.
Stepien sued Franklin and the radio station alleging defamatory remarks about his management of the basketball franchise. Franklin was accused of calling him a lunatic mentally ill and a pathological liar with remarks allegedly recorded on tape. The case turns on whether the comments were genuinely defamatory.
Stepien calls the dismissal of his suit unprecedented in sports history and plans an appeal despite a judge ruling Franklin's remarks were rhetorical. Franklin defends style as provocative while praising Bo Schembechler and denying literal intent. The quarrel began after Beapisa bought the Cavaliers in 1980 and peaked with a Toronto radio sting before Stepien sold the franchise in 1983 to the Gund brothers.
