Murder charge dismissed again in 17 year old case
The Ohio Supreme Court on a 7-0 vote dismissed the 1995 murder indictment against Terry Lee Whiting for allegedly killing Deborah L. Prince in 1981. The state had argued delays in indictment were justified. Whiting's lawyers cited prejudice to his defense due to years elapsed and unavailable witnesses. Debates over pre indictment delay had previously seen a mistrial in 1996 and appeals.
