Appeals from two criminal convictions to Court of Appeals
Appeals from two criminal convictions were taken under advisement by the Ninth District Court of Appeals during a four day session. Joseph M. Saleem, 43, of Strongsville, convicted May 17, 1968, of tavern holdup in Columbia Station, seeks a new trial on misidentification and trial errors. He was convicted in Lorain County Common Pleas Court for holding up Andrew Holoduk’s tavern Sept. 26, 1966 and escaping with 7000 dollars. Four witnesses identified him. one later saw his photo in a newspaper tied to another armed robbery case in Cleveland. Saleem, a World War II amputee, was released last month from the Ohio Penitentiary to enter a veteran’s hospital for treatment of a war injury. William T. Guarnieri, Cleveland attorney, noted Saleem’s testimony might have influenced the jury. Assistant County Prosecutor John Gallagher denied any confusion about identification. The other case under advisement was Irvin L. Smith’s first degree murder conviction for the fatal shooting of Walter Konarski, a Columbia Station farmer, who employed Smith and who also wounded Raymond Mattingly. The shooting occurred November 23, 1951, after Konarski refused to loan Smith a truck and shotgun for hunting. Smith was represented by Daniel A. Cook. state by John Lowther.

Vermilion City Battles Lorain Tax Reciprocity Plan
Vermilion Mayor Jene Maiden leads a drive against Lorain council's plan to nullify reciprocity clauses in municipal income tax. He aims for state legislation and has support from UAW Community Action Committee and Huron administration. About 80 percent of Vermilion taxpayers work outside, mainly in Lorain, risking revenue if reciprocity ends. Maiden will press the issue with the state regardless of Lorain's move, urging broader rural-city tax fairness. Benton Stacy reports department difficulties this week as the matter unfolds.
