A clerical transcript from a disputed November 1994 hearing raises new questions about whether Daniel Smith of Elyria had a chance to defend himself as he faced murder-related allegations. Judge Zaleski voided the 12 year sentence for six counts of aggravated drug trafficking imposed by Judge McGough, calling it a manifest injustice. He ordered a new sentencing after finding a secret meeting between McGough and detective Al Leiby violated Smith’s due process and confrontation rights. Leiby had not identified Smith as a murder suspect before the original sentence and later testified he wanted to pressure witnesses, while Smith was later acquitted in the murder trial.
