Justice Cross Explains Jury Dismissal
Justice James T. Cross outlined last Friday’s juror dismissals in a prepared statement while panel members completed two weeks of duty. He noted the nine excused jurors were not stricken from the list and their removal from the jury box was not acknowledged publicly. The nine served on a trial yielding a $9,000 verdict for Mrs. Esther M. Lemoine in a negligence suit against Michael J. O’Neill, with a reduced $4,700 option later offered. The judge cited insurance issues and said those excused should not be counted as available for further service, reaffirming confidence in Onondaga County’s juror selection and fair-trial procedures. A letter from Francis L. McElroy on Tuesday sought further explanation.
