Garwood judge upholds desertion dismissal in court ruling
CAMP LEJEUNE North Carolina A military judge Colonel R E Switzer refused to reverse his ruling clearing former Marine Robert Garwood of wartime desertion and one maltreatment charge while keeping the collaboration with the enemy accusation. The judge said the law and evidence supported the not guilty finding on the desertion counts and dismissed the remaining charges. He defended his standard of review as correct despite prosecutors argument that it was too lenient. Garwood spent 34 years as a POW after vanishing near Da Nang in 1963 amid accusations from former POWs that he aligned with the enemy.
