Communists Seek Test of Control Law
The Communist Party seeks a quick court ruling on the constitutionality of the anti subversive law. Abraham J. Isserman urged the Justice Department join the challenge. Irving S. Shapiro resisted, saying enforcement is the department’s duty. Isserman said the party will sue alone to test the law. The exchange occurred before the Subversive Activities Control Board. The board denied a 600 day delay but granted Jan 24 to answer, with Jan 4 for motions. Isserman indicated plans for a federal injunction to pause hearings until constitutional questions are resolved.
