Affidavit allowed in Cayuga land claim damages case
In a interim order Judge Neal P. McCurn admitted portions of the June 1991 Hutchins affidavit into the damages record. The history professor's testimony, used previously in a pretrial hearing, supports arguments that the Cayugas acted in bad faith in seeking remedy for lost land. The ruling comes as the case moves toward final damages, with prior juries awarding 369 million dollars and ongoing debates over added interest.
