Federal Court Rules For Radical Speakers
A three judge federal court in New York ruled that parts of the 1952 McCarren Walter Act violate First Amendment rights and barred government actions against radical alien speakers. The decision affects Belgian Marxist Dr Ernest Mandel who was barred from entering in 1969 to give university lectures. The court granted a temporary injunction against Mitchell and Rogers and said restricting Mandel denied citizens the right to hear debate. The dissent argued national security must prevail over free speech limits. Mandel had been slated to speak at a Stanford University conference after earlier visits.
