City faces PUC bid to buy United Water amid court clash

Attorneys for the city argue PUC lacks jurisdiction and a prior district court ruling favors Rio Rancho taking over the utility. PUC staff warn city ownership could cost ratepayers about 60 million over 28 years and may raise rates after 2002 while private operation might lower rates before 2000. If the commission backs the examiner, the district court decision could still allow the sale, with a Supreme Court ruling possible. An Oct. 30 deadline lingers as PUC sets a November hearing and possible extension talks.
