Supplementing Judges Salaries Ruled Illegal in WV
West Virginia Supreme Court heard that county supplements to circuit judge salaries violate the constitution, with the attorney general arguing such supplements transfer salary-setting power from the Legislature to counties. The Cabell and Wyoming counties challenged budgets seeking $4,000 and $3,000 supplements, while the law set a $20,000 cap with differing state shares. They contended two exceptions reduced the maximums and violated equal treatment, though the state maintains the full section is unconstitutional.
