Supreme Court to hear anti trust case on prescription plans
The Supreme Court will decide if agreements between health insurers and pharmacies to provide prescription drugs under prepaid plans violate federal antitrust laws. The Texas case involves 18 San Antonio drug stores suing Blue Shield of Texas and others over a plan capping copays at $2 per prescription, with the balance covered by Blue Shield. Non participating stores could recover only up to 75 percent above $2, arguing price fixing that harms small pharmacies and their services. The 5th Circuit ruled for the smaller stores, saying certain insurance aspects fall outside antitrust law but prepaid plans fall under it. The high court agreed to review the ruling.
