Farmers Win Big In Circuit Court Ruling
The 8th U.S. Circuit Court of Appeals ruled that bankruptcy courts must weigh a farmer’s skill and experience when assessing the likelihood of recovery. The decision affects Nobles County couple James and Mary Ahlers facing foreclosures after debt totaling over $450,000 with loans from Federal Land Bank and Norwest Bank. A dissent argued the ruling shifts risk from lenders to farmers amid a worsening farm economy.
