Flag amendment falls short by one vote in Senate

In a 66 to 34 vote the Senate defeated a proposed constitutional amendment to ban flag desecration, one vote shy of the required two thirds. The measure, sponsored by Sen. Orrin Hatch, would empower Congress to prohibit physical desecration of the flag, a response to Supreme Court rulings in 1989 and 1990 granting flag burning First Amendment protection. House Republicans also failed to advance the pledge of allegiance bill, as Judiciary Committee split 15 to 15 with Rep. Bob Inglis opposing.

Supreme Court Rejects Suppression Based on Vienna Convention

The Supreme Court ruled against two foreign suspects from Honduras and Mexico who argued a Vienna Convention right to contact their governments. Chief Justice Roberts said remedies such as suppression of statements or new trials are too harsh, while affirming equal due process and right to counsel for arrestees. The decision notes U.S. police often fail to inform foreign nationals of consular rights, but protects suspects under due process and attorney access.
