Couple files petition against zoning decision
A Montgomery County couple, Howard R Schafer and wife of Silver Spring, filed a Writ of Mandamus in Frederick County Circuit Court against the county Planning and Zoning Commission. They challenge the denial of preliminary approval for the Thornbrook subdivision on a 3365 acre tract along Orndorff Road near Emmitsburg, claim the commission abused ministerial duties, and seek reversal to grant preliminary approval. The suit notes an adjacent 11.9 acre Herman subdivision received approval the same day despite fronting on an unpaved road.
