Town seeks dismissal of furniture suit over antique limit
NEW MARKET The town asks Frederick County Circuit Court to dismiss a suit by Hill and Nancy Cline, who own The Browsery, claiming New Market General Store sells new furniture in violation of an antique limit ordinance. The town contends the Clines fail to substantiate the claim and notes officials, including Mayor Winslow Burhans and Zoning Administrator Larry Smith, have discretion in enforcement. The case names the town and officials and seeks investigation and enforcement, amid ongoing zoning policy debates and proposed changes to permit procedures.
